(Yet) Another Reason for Scalia to Recuse Himself in the Gitmo Case

Oh man. It seems like every day we learn new reasons why Supreme Court Justice Antonin Scalia should recuse himself from this ongoing Gitmo case about whether or not prisoners deserve a jury trial or a military tribunal. To recap, we’ve already learned that Scalia’s son served in Iraq for a period of time. And, Scalia already said how he’s going to rule on the case, before openning arguments were even offered in the case. In response to these facts, five– five (count them) retired Army Generals and Navy Admirals have called for Scalia’s recusal in this case. But now, we learn this.

Apparently one of the government lawyers in the case (Solicitor General Paul Clement) actually worked for Justice Scalia as a clerk in 1993. Pfffffft. According to Knight Ridder, Scalia appears to pretty much be nodding along with everything Clement is saying and agreeing with his former clerk, who he was apparently close with. How ridiculous. Scalia should have recused himself days ago for any one of these reasons. But in light of all three of them, he probably won’t recuse himself at all. This is ridiculous. But it goes to show what happens when a President appointes an extremist judge to the court, who doesn’t have respect for official U.S. Code, as it relates to the conduct of judges.
